At what point do Police/Sheriff searches cross the line?
I ran across this story on Digg this morning and found it interesting. It's about a man who was searched by Sheriff's Deputies without consent.
Outcry over Sheriff's Department search methods -- Page 1 -- Times Union - Albany NY Summary: A guy gets off a bus from NYC to Albany, NY. Deputies think he looks suspicious. They question him, he refuses to answer, tries to walk away. They take him into custody. They frisk him and check his bag, find nothing. Take him to station, strip search him, find nothing. Take him to medical center, have him drugged (sedation + amnesiac) against his will, perform colonoscopy (camera up the butt) against his will, find nothing. Turns out the guy was clean. Spent 10 hours in custody, now filing suit against department. I recommend you read the whole thing to get more details about the situation (Department has a history of "overzealous" searches at bus station, man in question does in fact have several drug convictions against him). So what's your opinion on this? Are officers and deputies justified in performing these kinds of searches in the name of safety? Have they overstepped their boundaries? Is this police state? I'll save my opinion for now so as not to influence anyone. |

Like all positions that have some kind of authority and power, its gonna be abused from time to time. This is just one example of millions.
I had a friend who was on the run one time. (he had robbed someone) The cops knew that the guys on my street always hang out together. We all grew up together. So instead of cruising, looking for him, they decided that it'd be better to stop myself and the rest of these guys everytime they saw us. I was pulled over 4 times in one week without even leaving my street! It was the same thing everytime. "Wheres ***** at?" "who" "You know who. U let him know we're gonna **** him up when we see him" "if I knew who u were talking about, I would" "well maybe you'd like to take his assbeating for him?" "I'll pass, can I go to work now?" That shit happened for 3 weeks before dude turned himself in. I know what some are thinking, guilty by association or whatever. But the bottom line is that I didnt rob anyone. Why is it that I gotta be harassed? Its an abuse of power by guys who are hiding behind the badge. That cop looked at me and figured I was just as guilty as my friend, because I hung out with him. So I could look at cops and think they're all cocksuckers because of the way a few were acting. right? Sux for the cops that are really trying to make a difference and do good. As well as the everyday civilian, just trying to do good. |

actually if he had any sort of prior conviction and was on probation, he automatically waives the right to consent of search and seizure.
part of the concept of probation, is that you can hide nothing, and refusing a search or actively protesting against it is a violation of that probation, especially if it's probation for a past conviction for drugs etc.

I was profiled a few weeks ago, and the friend I was with has never experienced that. (caucasian btw)
We went somewhere, and were not allowed in. She was at the same place a couple weeks prior with her father and was welcomed in. She started to ask questions and told the guard that she had just been there and blah blah blah. I stopped her and told her lets go. She couldnt understand why they let her before and not now Then I told her "U were with ur dad last time, not some 20 somethin year old Mexican guy with tattoos all over the place." Then she realized it. She started apologizing and all that. I told her it wasnt her fault and I didnt care. I was just glad because she was able to open her eyes a little. |
