Why would the driver be looking at jail time? The car was boxed in - couldn't flee. I don't think 12 reasonable people would disagree that the driver was in fear of grave bodily harm.

Driver could have easily run him over twice. Don't think that would have resulted in any charges either.

But I was only a LEO for a few years & have only had a CCW for 7 yrs - I wouldn't know....

If the person runs him over, or even she/he shoots the guy I don't see why they would get any jail time. The person was clearly attacking them/their property. They could of run him over by self-defense.

Tell me, if that was you or your family would you give an attempt to run him over or give him a possibility to hurt one of your family members or yourself? I would clearly run him over. Look how much witnesses there are seeing that happening. They would all say that the man was attacking the car with a possibility of getting someone hurt.

He can file a civil suit only if he lives. My definition of neutralizing a threat does not leave room for that situation.
