Ok anyone whos good with law...
This is going to be a very vauge story so yea..
So, About a month ago (at school) my friends found a School ID card, (we use thses cards as like a debit card for food) so they spent money from the card..Now I had no idea there was a stolen one, and we usaly use each others cards for the vending machines..Now i used to, Unknowingly and got a Starburts..($0.85)..Now my friend spent like over $30 and held onto the card, he got 6 weeks of L.O.P in the school ( Loss of Privleges so you get a half a period for lunch basicly) AND a Felony...Now i thought a felony would only be $300 and up? But my main question is, What about me? I used the card unknowlingly, had really no idea about the card and spent only 85 cents..Would i get a felony? or I would atleast be thinking about a misdameaner.. But also the cop said to ME and my PARENTS "Evan dose not play a big role in this" and i'm 17, 18 in july.. So yea, I'm just wondring..i may know tomarow. |

I am not a law expert but I think this would be considered fraud not just petty larceny and that is why it could be a felony. I highly doubt that you will get into any trouble. If you're not sure though and they already nabbed your friend tell him to tell the cops you had nothing to do with it.

you will be ok, give the 85.cents back in a money order, know that you know... its not a felony :) pety theft....under 300.00, I use to be the head of Loss Prevention and sent many people to Jail :)

it is in fact a felony. as stated earlier it is fraud. just like using someone elses credit card. your friend acted as another person and spent money on that persons name. that is fraud and is a felony. however you can not be convicted of the crime because there is no intent and you did it unknowingly.

If I hadn't made any sort of admission to anyone other than my parents, like other students, friends, teachers, police, etc., I wouldn't volunteer a thing over the $.85. If I had, I would try to see If I could avoid getting involved. Sometimes the worst thing you can do is cop to something minor and expect mercy. The card was not in your possession and you could not really be expected to remember something so trivial as $.85 for starburst (that they cost $.85 should be the crime here) and anything said to the contrary would be hearsay. Everything you learned in Sunday School won't necessarily help you when dealing with authority, even though it always worked on "Leave it to Beaver."
Stick .85 in an envelope and drop it in the person's locker. |

In Calif. over $500 is a felony, over $500 is grand theft. $ .85 cents is very petty and if they want to pursue it, it would be a misdemeanor. They could take action against you IF they want to make a example out of you. When your friend got the felony, I don't think it was for using the card, it was for possession of stolen property. Possession of stolen property can be a misdemeanor or felony, depending on how the cop writes it up. See, what happened with you friend is that he kept the evidence that they needed to prosecute him. You on the other hand, would be a accessory to the crime which usually ends up with a slap on the hand saying don't do it again, unless its a violent crime. If the crime is non violent, usually you get leniency. Violent crimes usually gets you the max time. I know more about the law then the average joe schmoe cop. Hope that answer helps ya.
