Just got a speeding ticket....do you think i should take it to court?

Hey what’s going on guys. Just got a speeding ticket and was wondering what you suggest i should do. Here’s what happened:

Got pulled over and cop...asks me how fast i was going, i said about 70. He then says he thinks that i was going faster than that and he was following me for about a mile but could not get to me because of other cars. He then leaves, comes back and says that traffic was going about 80 and that he thinks i was starting to pull ahead of traffic so he put me for 84mph, in a 55mph zone.

Questions are, should i bother fighting think, as i really dont think i was going 84. He didn’t say anything about getting me on radar, since he was behind me.

Other info: This is my first speeding ticket and i was going to an important dr's appointment.

What do you guys think and any advice would be much appreciated!

Thank you

The thing that you really got to consider is that who is the judge going to listen to? of course the CHP that gave you the ticket! but here's one thing that you can try to do... doesnt always work but ive heard of some winning this way.. The day before your court date... go and tell them you have something extremely important to do the next day and ask for an extention..... do that ONE more time.. (i think your allowed to do it twice) and if you're lucky.. the cop will be too lazy to show and thus.. you win the case.. Case Dismissed.
You could try to fight it but you better have a better arguement than "I was going to an important dr's appointment"

Hope this helps.
Good luck!

actually just stall the court date as long as you can. Find good excusses. I know it's probably illegal to do this but... just tell them you have a test that day or you can't get off work. Something. And that for as long as you can until they say you HAVE TO be there. And chances are the Cop won't show up an you get a "get out of Jail Free" Card. But NEVER EVER EVER EVER admit how fast you were going!!!!!!!!! Say NOTHING.... Maybe you that you don't know "with the flow of traffic"

i would say take it to court but remember it is your word against the officers, and the fact that the officer wont show up good luck with that i dont know how it works out there but court time means overtime which means more money for the officer.

hahaha i wish.

we only get 1/2 of our pay to go to court. trust me its not worth it. but i go to everyone for the fact that people always get mad at me for giving them a ticket and want to know if ill be in court...

I'd fight it in this case. Yes you were speeding, but I've read from several sources that it's usually better to keep up with the flow of traffic (if everyone is speeding) than go the limit and cause a danger to everyone trying to pass you. That doesn't mean go 100 mph, but if everyone is doing around 75, I don't know many cops that would expect you to let everyone pass you while you're only doing 55. That said, the cop doesn't need radar to prove you were speeding or driving unsafely, but it will certainly help you that he has no documented evidence.

My word of advice is to be honest with the judge and be as sincere as possible. If you try to BS him/her, it might bite you in the ass. I've gotten a couple tickets in my day and I fought them, sometimes successfully.

This is 100% untrue. If you go to court and the citing office doesn't show, the evidence and statements filed still stand, and you still need to defend yourself against that. Say you get caught on radar and the cop doesn't show. If the judge gets a copy of the radar info, it's likely game over for you even if the cop doesn't show. However in a case like this where it's pretty much the cop's word against the OP, he stands a pretty decent chance at getting out of it if the cop doesn't show. But he still needs to make his case and convince the judge of his innocence.

That sounds like a really bogus ticket, and since when does traffic go 80MPH in front of a cop? This guy is a complete jack ass.

What state are you in. I am in Idaho right at the moment and it seems like I get pulled over and let go every 2 weeks, usually something bogus but I try to be nice and so they let me go.

I got a ticket for weaving between traffic once and the cop was nice and all he said he could've gotten me for reckless driving and I could be arrested but he dropped it down to Failure to Maintain Proper Lane. Then he told me to fight the ticket because he never goes to court. At this point I'm like why give me a ticket in the first place, but I didn't argue. I went to court and he wasn't there, however maybe it's just CT court systems but if you go really early, you can bypass the judge all together and just talk to the prosecutors. She had a copy of all the records from my ticket as well as the officers account of the situation in writing. She asked me my story and said I can either appeal and wait for the judge or pay $35 instead of $90. I chose the latter.

As long as you're not getting tickets once a week I think it's a good practice to always fight the ticket. I've been stopped about 6 times since I started driving 4 years ago and that was the only one that I had to pay.

Why do you still have a babysitter when you're 21 years old?

I would always fight it. I remember hearing somewhere that 30% of cops no show on court dates, and even if they do show up just plead your case with the judge and he may rule in your favor or at the very least reduce the fine.

Edit: OOOO, my 500th post!!!!!

I've had a similar thing like that happen to me twice...first time I got a warning..and I really pissed the cop off (un-intentionally) by asking him to see his radar...and he said he didn't clock me, he "Pace clocked" me..OOOOkkkkkk...so anyways..he wrote me a warning.. Second time though...apparently he thought I was racing...when i really wasn't..I was going like 52 in a 35...and he said i was racing a CHEVY IMPALA?? LOL..so anyways..that time I got in a bit of trouble..I had got a ticket in Tennessee like 6 months prior, and forgot about it..had been driving on a suspended license..and all I got was a notice to appear..he didn't even tow my vehicle..sat there with me til a buddy of mine came and drove it home..he just sat there and bs'd with me about my car..he ended up being a really cool cop...even though at the beginning he was all cracked out...

But back on topic, yours sounds kinda bogus..like he targeted u in particular...you shouldn't have a problem, the cops never go to the court date, and no proof FTW!

And Mordekyle, meant to ask u a question..I always hear that is illegal to have a radar detector? Is this actually true, and if it is..why don't cops do anything about it?? like convisgate it or something when they pull u over.. when that cop pulled me over the last time..my radar was just beeping away when he was behind me..lol..and he didn't say anything..

I was just picking on my buddy Alex because everyone said his new Impala was fast. He replied causally that he would race my Si for slips because his SS would eat me for breakfast.

So this morning I did a bit of research on the Impala SS.

Quote:
A small-block 5.3-liter aluminum V-8 with 303 horsepower and 323 pound-feet of torque.

Car and driver put down these numbers in it.

0-to-60 time of 5.6 seconds, the quarter-mile turns in 14.2 seconds at 101 mph, and the ungoverned top speed is 154 mph.
I don't think I will be talking trash to by buddy any time soon.

P.S. FIGHT THE TICKET!
