He's charged with a felony charge of aggravated animal cruelty. If convicted, he could be sentenced to up to two years in prison and ordered to pay up to a five thousand dollar fin. The dog's owner, Bill Sampson, watched in the courtroom Thursday. He said he wanted "justice done" and vowed to attend every court hearing. Aquino's attorney, Joseph Tock of Mahopac, offered a few words in his client's defense. Tock said the case is sad for both families. He said the incident is a complete aberration and that his client has never been arrested. Sampson's dog, Roxi, a 15-year-old mixed breed, strayed onto Aquino's property May 30. A guest at the party, Alfred Pizzuto, said he saw Aquino kick the dog "like a football," causing the 45-pound animal to stagger away and die under a tree nearly two hours later. The witness said he had no idea whose dog it was, and he did not think it was injured as badly as it evidently had been. Putnam Valley's animal control officer, Patricia Smith, said animal abuse is a serious crime that suggests how people treat weaker beings. Tock said Aquino had received some threats of violence and now was concerned for his own safety. http://www.wnbc.com/news/4592898/detail.html |
