Can Advice Cause a Lawsuit?

So I was wondering, Can giving out advice on a forum give enough reason for a lawsuit. If someone were to give the wrong information and an engine blow up, or somthing could the person with the idea be held liable? Thanks

HUH...Not up to anything, I just wanted to know if I were to give some advice and it were wrong and someones engine blew up could I be held liable. I am a straight shooter!!! WEBBY/MODS?

No you can't be held liable unless you sign a written contract that you want to be held liable. That's why we always want it in writing right? If it's not in writing then it's just like writing something on water.

I don't think so.

Anyone providing information on this site is doing so without payment, so they are not liable for any claims, written or expressed. If you are paying someone, you ensure that they are professionally trained and capable before performing a service (that goes for anything).

Some professions are bound by an obligation to the person whom they give advice, whether for free or payment - doctors and lawyers come to mind.

some people have in their DIYs a little disclaimer saying you do this at your own risk, whatever you may do to your car in the process is your fault etc...

probably not enough to really stop a determined lawyer, but good enough for most cases

Yeah if you are a car mechanic, honda service technitian etc, and you give advice on a car than you should prob say try at your own risk, which you should say anyways, but if you have no professional knowledge in the area I wouldn't worry too much. And it never hurts to say that to whomever you give info about engine modifications to.

As aboveforementioned (i always wanted to use that) Professionals are ethically bound to back up what they say. A disclaimer is always good.

but i think he wants to DIY something on his engine. but if ur afraid of blowing up ur engine. let a professional handle it, therefore if ur engine blows up then, u can sue

Yep. Certain professions have a higher obligation to the advice they give out. So Lawyers and Doctors automatically assume responsibility for a person the moment they give out advice, free or paid. I know for a fact that once a Lawyer gives out advice to a person, the lawyer must from that point on be responsible for all actions derived from said advice and the person becomes a "client".

To avoid liability on this forum, if you're a mechanic or a tech guy, avoid giving advice or saying that you are such. Chances are you'll never be brought into a suit for blowing up someone's motor, because honestly a 20K car is nothing in a lawsuit where you have to hunt someone down across the internet and try to prove everything.

lets put it this way....if you are driving your car and come to stop at an intersection with 2 other cars....car #1 waves you to go ahead...so you start to go but car#2 starts to go. you get in an accident, is the driver of car#1 at fault? i would think you would hold it against them...because you took their advice to go and got in an accident.
