you dont even need to take this to court! just go to the police station and ask to speak to a sargeant or captain. tell them the situation and ask for them to check out the car to see if they think the ticket is legit. i guarantee you they will get rid of the ticket right then and there. the police work just like any other company. u dont like how one person operates the show u can go up the chain of command to complain. dont waste ur time in court. dont be an asshole when u go in there. just ask to speak to someone high up and tell them you feel u were wronged and what their opinion is on the matter and if they can do something to right the situation. be very polite and respectful it will get u very far. oh yeah and bring at least 2 witnesses with you. not your friends though maybe like a parent or someone else u know who might be older or a professional of some sorts.

next time thi shappens ref`u1se to accept the ticket and ask him to have who he reports to to come to the scene. if he wont do it then grab ur cell phone and dial 911 and tell them the situation and that you would like someone higher ranking than the officer who pulled u over to come to the scene. that is absurd and unjust what the cops do sometimes. andi still dont get how cars can have laws against them for loud exhausts when u have motorcycles out there.

I'm no lawyer but I do work with the Justice Department albeit not the NY system. I have a simple solution. All you need to do is show up to court with a bullet proof defense. The NYPD likes to pick on young "racer types" because they are easy targets and they are less likely to challenge a ticket thereby creating alot of money for the city.
DO THIS. 1.Call American Honda at their Customer Service number and have them fax you a letter stating the part numbers for the stock muffler on your Civic Si. If they can also provide you with a picture of the muffler than tha would be useful too. They shouldn't give you any trouble with this as long as you explain your situation. If they give you trouble, threaten to take them to small claims court for the amount of the ticket and all associated legal fees and lost wages. 2. You now have to prove that the part number that Honda listed as being the stock muffler for your car is the part that is currently installed on your car. I don't know if the part number is etched or written on the muffler itself but that is what you will need. A picture of the muffler itself may or may not suffice because of how similar all mufflers look. The judge will probably throw this ticket out without so much as a second thought. There are a ton of people waiting to have their cases heard and the judge does not want to waste his time on a losing battle. CASE CLOSED!!! In all likelihood, you may not even get to that part. In some cities, you see the cop who gave you the ticket first and tell him you plan on contesting the ticket. At this point, he offers to lower the offense if you plea guilty. For example, he will lower you excessive noise violation to something less serious like a seatbelt citation. But anyways, show/tell him the evidence you plan on presenting in court and he will give up. He doesn't want to show up to court for a losing battle! In all liklihood, you will not see the judge on your appointment date. They will probably have you enter your plea. If you plea guilty, they'll give you some paperwork and have you pay at the cashier. If you plea not guilty than they'll give you a court date an then you'll have to go back on that date. PM me if you have any other questions. Hope this helps! |
