They might try to claim that you abused the car, but like you said, the miss-shift wouldn't be related to third gear at all. So unless they can actually prove that the problem contributed to third gear, it shouldn't make a difference.

Good luck.

P.S. Have you tried swapping the tranny fluid w/AMSoil or GM Synchromesh?

man, when i first got the car i must have gone into 4th from 5th trying to go into 6th like 20-30 times... and so did people that test drove the car. but i and everyone always noticed, and becided it was a normal shifing at 4000rpm so it would have jumped to 5500rpm... nothing... hell crusing at 100km/h i shift to 3rd and the rpm goes to 6800-7000rpm... but its from 3000rpm.

So even though i have mis-shifted quite a few times, luckly i have never let the rpm hit over 8500, even though it dose goto 8600 in 5th but i wont get into that...

I've been searching for a while, but couldn't find a good answer for how long the Ecu remembers the history of the engine parameters. Someone said 50 miles, which seems like a realistic estimate, but I was wondering if anyone knew for certain.

My car only has 5600 miles on it, and has the 3rd gear problems, and I really want to get the car fixed, because I plan on driving it for the next ten years, or until it dies. My car is still 100% stock, i never race, and I take very good care of my vehicle because this is the first car I am paying for completely myself and I want it to last for a very long time. I enjoy vtec every now and again, but only when I am getting on the highway.

Basically, once I know how long the Ecu records driving history, I will simply not go above 3k for that long before taking it in, so there is no chance that they can claim i have abused the car.

Any responses would be greatly appreciated

Hmmm i wonder if they can pull info like that, legally.... I know that insurance companies do not have the right to ECU logged info in the aftermath of an accident. I do know that it is within there right to pull trouble codes(ie over rev code) but i wonder if they can do other things. Its kind of a "self incrimination" thing (but not quite)
