A Month ago I got into an accident, not to bad at all, messed up my front bumper, and my intercooler. It was at Violation of Right Of Way right off the exit of my neighborhood. So I get ticketed, and blamed in the accident for supposably not waiting, but I waited a good 4 minutes to exit the neighborhood while looking both sides and all, but to me it seems like the guy on the motorcycle was probably going high speeds when he was turning into the neighborhood.
Anyways, the point is, nothing happend to this guy at all, he didnt fall, nothing, my car got ******. Now I find out by a random attorney that called me that his license was suspended awhile back, and hes not suppose to be driving a motorcycle. Im not at fault anymore, but can someone explain to me the sueing process if anyone has be in a situation like this. I dont want to sue the guy to tell you the truth, not worth my time, but how does that work? |

The insurance is paying for that hopefully full coverage.
I have a rental aswell that they are paying for, but the fact of the matter is that I dont see sueing as a good thing, but he wanted to try it on me, and thats the messed up part. He faked his injurys, and faked alot of stuff to hopefully sue me, and I didnt find that nice at all. But to tell you the truth after the call about his license, I dont feel like I should pay anything at all, not even a deductable to the insurance. Last edited by SpeedDemon; 05-13-2008 at 09:58 PM. |

Yea for now my insurance company is paying for my stuff.
Its been almost a month already, and it seems like I found out about this today, that his license has been suspended, so tommorow im gonna talk with my insurance company and report that to see if it makes my situation better. |

It depends on if it is no-fault insurance (your state) or fault insurance.
If it is no-fault, unless one of you was legally parked, your own insurance will have to pay for it. Lovely, hey? As for the others, even if it was your fault because of the accident, his not having a license supercedes that, I believe...therefore, regardless of fault, he wasn't even supposed to be driving. That's what I think, at least...

I dont wanna go that far by sueing him, even though he deserves it for faking his injurys like if he was ready to sue me, and plus he said he had the same insurance as me so im guessing he does have insurance.
But I dont see how my own insurance didnt notice that his license is suppended. |

Nail him for all the charges needed to repair your vehicle and leave it at that, don't milk him for money like every other concieted american is.

i would take it to an attorny atleast. were not legal advisors(some of us could be considering how huge this community..but nonetheless) you shouldnt have to pay a dime as far as im concerned...i think you may even deserve something for him trying to screw you..too many good people get screwed in this country, sounds like its a chance for a good person to get something from a not so good one. good luck
