need advice/help

Alright,

in December of 2007 my brother got into a non-at-fault accident. Some rear ended him. While the car was in repairs we rented a car and refused the renter's insurance because our insurance company was covering us and they were paying for the rental.

While we had the rental my brother was caught in a snow storm and slid into a curb causing the axle to bend. I understand that is his fault regardless of vehicle condition. I should checked the tire thread but it was bald.. they probably changed it by now.. (i was in the states visiting inlaws at this time), so he didn';t know what to do.

The rental company sent a tow truck and gave him another car on the spot.

so we contact our insurance company and they created claim.. so we forgot about it..

a month and half later we receive a letter from the rental company saying we need to pay for damages of $2775.

I called the guy the letter came from and told him to contact our insurance company and gave him the claim #... another 1 month went by.. another letter comes saying the same shit.. so i called him again and told him to contact our insurance company.. i called my insurance company and they said no one has called and they cannot get in contact with them.

so today i get home and another letter is here saying if we do not pay in 15 days they are going to take legal action. So i am pissed now... i told him several times to contact my insurance company and everytime i call him back with the claim number he doesn;t call back saying he got it or anything..

so i called today and left a message saying he can threaten me all he wants.. and i explained to him the WHOLE Story again on how he should contact my insurance company.. I gave him my policy number and phone number of the insurance ...

I am also writing an e-mail and CC'ing it myself so i have a paper trail saying i sent him an e-mail as well.. i should e-mailed him before.. but yah..

is it legal for them to keep threatening me when my insurance company was insuring me on that vehicle at the time of the accident?!?!

or can they do this because i refused their insurance?

some advice would be great.. thanks ; >

Sounds like a great deal of miscommunication. But aholes lawyers or collections can threat all they want.

he's not even a lawyer or collections..

he's part of the AVIS Vehicle Claims Dept..
