An officer friend once told me that as long as they don't have you in the radar gun they cannot hold the ticket up in court... He told me to ask the officer if you can see the gun to see the speed that you were going... they are not allowed to deny that...
I haven't had any tickets since he told me that to say it is true, but I guess that it is worth to give it a try... Good luck! |

Most agencies (like mine) will provide "visual speed estimation" training through POST (Peace officers standards and training) that allow you to testify as an expert on visual estimation of speed. I go to court probably 6 times a month on speeding alone--some bring lawyers some don't . But from a court room, it's hard for an attorney to challenge training provided by a state-run organization---especially given the fact that there was nobody else on the road. If he cited your for 22350 CVC (basic speed law) or 22349 CVC (exceeding 65 MPH on any highway) then your best bet (if you can) is to ask for traffic school. 90 in a 65 (if that's what is was) is a towable offense. People always ask what the best way to beat a ticket is..and for me..what I hate the most for speeding cases, is "Trial by Declaration." For me, it's a total waste of my time and I usually won't do about 1/2 of them. Basically it's a 4 page form I have to fill out and then I have to write out a "Play by Play" of what happened, my training, my qualifications, etc. But--with that being said, when I have done them (maybe 50 a year) i've yet to lose---so it's a gamble. I was in court the other day for '51 in a 30 zone'. There was a representative for the officer there in his defense. It too all of 20 seconds to get dismissed. The officer had failed to check a box to specify whether he had 'estimated' my speed, but had written that I was doing 51. As soon as the Magistrate heard that, it was end game for the PD. IMO it's worth fighting a ticket as long as there appear to be mistakes on the ticket itself. If you're really guilty and it's a big ticket, get a lawyer, preferably one that's close to the court where you're due and one that primarily deals with traffic offenses, they tend to know the Judges and that will give you a better chance. If the ticket happened further away... You can request that the hearing be held closer to you, chances that the officer will not appear and the issue will be dropped.... Also, it can be worth heading over to the PD that issued the ticket and asking for Radar Calibration records (only applies if you were radar'd). GL
