cell phone ticket...

In case you arent aware, CT has a law that states you cant use and handheld devices while driving, which includes cellphones and anything else that could be a distraction. the law, I believe, was originally created as a reason to pull over the people who SHOULDNT be talking on a cell phone while driving. Meaning the teenage girl who is swerving over 3 lanes of traffic on the highway fighting with theyre boyfriend or the old lady trying to figure out how to turn the damn thing on.

So yesterday me and my girlfriend are driving to a couple stores to run errands, i make a turn at an intersection and notice a cop on a motorcycle on my left. I look at my speedo, not speeding, good. so i continue driving and he pulls out and flips on his lights behind me, I pull over. My girlfriend and i look at eachother trying to figure out what i did to get pulled over. I tell her "its probably because i dont have a front license plate". The officer comes to her window and i roll it down. He says "i pulled you over because you were talking on a cell phone while driving", i said "a cellphone? no i wasnt. my phone is in my pocket and has been since i left my house". He doesnt want to hear it and takes my license and reg. He comes back 5 minutes later and hands me an infraction- a $100 fine for "cellphone while driving". I point out the motorola bluetooth headset right next to me in the little coin holder behind the shifter. He says "i saw you holding your hand up to your ear, turn and look at me, and noticed you holding an object that appeared to me to be a cell phone." Ok.. i respect cops but this cop is an idiot. I have a bluetooth headset next to me that i use ALL the time because of this dumb law. Anyways, i finally say "well im not going to argue with you about it" and at this point i believe that he knows he was wrong because he tells me that if i go but a cheap handfree device, and mail in the receipt with the ticket, it will most likely get dropped.

I leave and go straight to the police station and talk to the sergeant about this retarded ticket and how i would like to save myself the hassle of fighting it. I bring in my bluetooth thing, and my cell phone, show him my calls list and that there were no incoming or outgoing calls anywhere in that time frame. He says he wasnt there so he doesnt know the situation and recommended that i write a letter and mail it in with the ticket. This is how my town is.. within a 1 mile stretch of road there was 4 cops, 2 cruisers with people pulled over, 1 cruiser shooting radar, and the blind motorcycle cop. I was wondering if this has happened to anyone else, guilty or not, and how you dealt with it.

EDIT: i should mention that what i was actually doing was chewing my fingernails.. i knew it was a bad habit but a ticket? damn!

just shitty luck... but i LOVE this law.... even though it doesnt stop anyone. guy who caused the accident in which i was rear-ended was yapping on his phone and not paying attention to traffic.

dude the same thing happind to me!!! but the cop let me go i was fighting with him saying that i wasnt cops have nothing better to do anyway's up there

Wow that sucks, I also hate people who talk on the phone in the car without a headset. As much as I think people look like tools with those headsets, I even bought one (used in car only!) because it is just not feasible to be rowing through 6 gears with one hand on your ear and one hand on your wheel/shift knob. Gluck with the ticket!

That's ridiculous.

Your best bet is to mail in a copy of the phone records from your bill whether it's online or through the bill you receive in the mail. If they don't believe the phone as it can be deleted, the paperwork will show you didn't answer any calls during that time period.

wow that sux, not to change the subject or anything but tonight i was on my cbr 1000 and while sitting in the parking lot with the bike turned on, a bicycle cop comes up to me and tells me i need to get my headlight fix, im like wtf r u talking about, "thats the way its made, the other light comes on with the highbeam", he went in front of my bike and i turned on the highbeams and blinded his ass, it was funny lol. ok back to topic, i like the cell phone law but not with dumb or blind cops

yea i work for a cell phone company in california and our law takes it to another level....it also states that anyone under 18 cannot at all use any mobile device even if they have a bluetooth earpiece or even in the car. anyone under 18 CANNOT use a cell phone. pretty funny all those youngsters will be surprised when they start getting those tickets...

thats a really good idea.. hopefully they will cancel the ticket over the mail i would hate to have to take off work to go to court to fight it.

i wish every state had this law! i agree.

if you werent on the phone, then id fight it. you probably will have to get a copy of your call log from your cell phone provider and just hand it to the judge.

BT headsets ARE NOT any better than being on the phone. They still make people drive like morons.

i see people TEXT MSGing now on their phones while driving, are they kidding?

I think BT headsets are fine... as long as the people dont have to go fishing for it when the phone rings. if youre gonna use it in the car... just put it on before you start driving.

personally, i have the avic-d3 w/ the bluetooth module. i love it... phone connects to it as soon as i turnt he car on and its a simple touch of a button to answer the phone... it doesnt effect my driving much because i feel like im just having a conversation with someone else who is in the car.

we'll probably be seeing so many cars pulled over in cali when the law goes into effect but i think ppl still wont care

That sucks. If I was the sergeant, I would have been convinced looking at your call log.

For those of you that don't have Bluetooth headsets, get the Sound ID SM-100. Works well, fits comfortably, and pretty cheap at buy.com .
