You don't, its not up to you. It's 100% up to your insurance company.

You should have been making nice with your agent and your adjuster, as well as the shop the car is at, because any one of them can easily sway the decision one way or the other if its close to going either way.

the op's car is definitely totaled, as for the other guy i dont believe it should b more than around $5,500, i hit a dear recently and had similar damage and mine was $5200 and my insurance covered it all

If your car is at your body shop "not the insurance body shop" go and talk to the manager of the body shop and tell him you don't want that car any longer and ask him to help you make the insurance pay for total lost; if he wants to help you he will ask the insurance more money to fix it and that's where the insurance says: forget it, is cheaper and better for us to total it than repair it.

You have the right to take your car to the body shop of your choice and/or the most expensive one.

Most body shops use crazy cheap aftermarket parts and probably none of them buy Honda OEM parts.

For example, I needed a new front fender on my 92 Accord, the dealer wanted $250 for it, the body shop charged the insurance $650 and I found the receipt on my car for a $25 aftermarket cheap chinese fender which didn't align properly, was like paper thin, etc... I complained to body shop and they told me was OEM, that the receipt was for something else and that there is no Law that requires them to use oem parts anyway.

I see many cars on the road with bended frames and the cars look like not going straight from behind.

Well just heard back from the insurance and it deff is totaled.

Everything taken care of and currently looking for a new car, hopefully looking into a new car sometime next week.

What a stressful week

Be a nice upgrade civic. I know before i picked up my si, i was looking into the ex accord 4door. Also, the 2013 accords are looking very sharp.

yeah just another honda and I would be happy

loved my vw gti before my transmission went but had to let it go, was to many issues

was very happy the turnout and how my insurance company handled everything

all is good

will post pictures of new ride whenever I get it

Sadly, I saw I the damage to my car before the fixed it and I bought it and it wasn't even half as bad as your pics show, and they claimed it totaled -_-
