God damn, just got a speeding ticket and the cop was a ****k.
Long story short; it's my day off today(Thursday), so my friend and I decided to go to the casino. we both were driving our own cars, and I was in the front. It was about 12:15am. No traffic, just 2 cars behind me. I got pulled over right in front of the exit to the casino. I was going down hill at about 75-80mph in 65. My friend stayed right behind me at the same speed. The cop parked on the road shoulder with all the light off. As I passed by, he turned on all the lights and chased me. I was cited going 93 in 65. It's 22349(a) VC. He also put his radar unit+ on. That god damn radar is so off. I am gonna contest the ticket for sure. Can you guys help me out and give me some idea about how to fight this god damn crap.

Should have looked at him and asked when the last time his gun was checked. I was with my father-in-law once in his CLS550 and he got pulled for doing 85 in a 60. Asked the cop when the last time he had his radar gun checked and he just said have a nice day and let us go.... I think they have to get them checked every two or three months, so chances are, his hasn't been checked....

Hope it's not too late but there are few things you can do:
1. If you got ticket during night time, try to schedule for a court date during day time. 2. When it comes to your court date, call the court and reschedule it for another time (2 weeks later or more, just make up some excuses). 3. Repeat step 2 and schedule for another court date (if possible). The longer the court date the more advantages you'll get. Some advantages are: *If the cop doesn't show up, you'll automatically walk away a winner and case closed. *If he does show up chances are he will not remember you and all the details during the time/date that he gave you the ticket. *You remember the details better then the cop so just use that to attack him. Make sure you're prepared for the rebuttal. (ie. Ask him for proof that his radar gun was calibrated during the time he gave you the ticket.) If anything bring out your friend as a witness, that you two were going at the same legal speed limit and so on. *If all else failed, it doesn't hurt to ask for a reduction in the bail amount. I got the ticket at 12:15am at placerville US-50. He could be either a swing shift or graveyard shift. The court date or pre-hearing(I think that's what they call it and that's when you plead guilty or not), anyways, the date shown on the citation is 8:15am on 11/16/2010.
I've done some research. Here the information I've got so far. Option 1: Plead not guilty. Pros: if the cop doesn't show up, the case will be dismissed, or he can't proof his radar gun wasn't calibrated before he gave me the ticket. Cons: Traffic school is not available when plead not gulity but found guilty later. Also, most of time, the judge takes cops' words over ours. Option 2: plead gulity with explanation stating no intention to drive over the speed limit. I was going downhill, not familiar with the area and didn't pay attention to the speedodometer. clean driving record since day one, 6 years, and first speeding ticket I've ever got. Pros: fine reduction? No point taken off? eligible for traffic shcool. Cons: The judge doesn't give a *** to whatever I say, and no traffic school for me because that's not an option when going over 90mph. The ticket will be on the record for the next 3 years. So what you guys think? |

(Speeding ticket wise), if so, ask for driving school, if not lawyer up. Overall points on your record? Are you positive/0/negative? If you're in the 0-neg range, lawyer up. It's better to pay $1200 and keep your license, then pay $400 and lose it for 6-8 months. |

Gee...why would I lie on a forum..You don't know me, I don't know you. Honestly, I was going at 75. It could be 80 at the most because I was going downhill. Although I have nothing to prove this, but consider that our car has a digital speedodometer and it's very easy to access to. Plus, my friend's car is FG2 and he told me he was going the same speed I was going which is 75. Chances are, the cop didn't use the gun properly? No recent calibration on the gun? or the gun couldn't catch the right speed if the car is going downhill? or it also could be I and my friend both were going at 93 but the speedometer says 75 since we both have the same car.
