Alternative method to fight traffic infractions.
Greetings fellow 8th gens...
First off, if you get a ticket you deserved pay for the damn thing. If you have been falsely accused of a traffic violation you did not commit then here is something to consider. I recently got a seatbelt ticket near my home. Approxiamtely $90 ticket and was seriously considering of paying the fine and forgetting about it. But I was pissed off because I didn't deserve it. Asked around and people say to get a trial date and hope the cop doesn't show up. I wasn't satisfied with this route so I searched online and after many websites I stumble upon "Trial de Novo" aka "Trial by Declaration". Basically fill out a form of who, what, where & why. The ticket issuing cop must submit his own written statement. Now when you submit this form you must pay the fine. If the opposing cop doesn't write his statement or you win the judgement the posted fine will be refunded to you. In the case that you are found guilty you have the option to appear in court along with the cop. So in essence... you have 2 chances to fight an unjust ticket. I got off my ticket. End of story. Hope you took something away from this. Here is the link to download the form. Gives you instructions. California Courts: Forms |
