actually if he had any sort of prior conviction and was on probation, he automatically waives the right to consent of search and seizure.

part of the concept of probation, is that you can hide nothing, and refusing a search or actively protesting against it is a violation of that probation, especially if it's probation for a past conviction for drugs etc.
