I don't really see how they could prove that an aluminum shift bushing could cause your problem unless it was improperly installed or somehow damaged...

They prolly damaged it themelves when they did the third gear fix just so they could use it against you later. (yes i think ALOT of dealership shops/mechanics are shady that way)
