Suggestion:

The first time you bring it in, insist that you are present when they try to "duplicate the problem." Don't let them make the first call on this, as this is where your case file starts, and ends possibly.

The reason that they can't seem to duplicate it without your presence, is probably because they are instructed to do so, same reason Honda knows clearly of the existence of this problem, but refuses to admit anything is wrong, and officially "have no position".

Our presence is required to force-feed our dealers the undeniable truth that this MTF is a POS and then mandate the follow-on inspection by American Honda. They are instructed to not be able to "duplicate the problem" because a large percentage of initial claims get dropped due to customer frustration, and therefor never make it to AH.

Think about it. After bringing your car in say twice, having to leave it all day, just to find out they cannot replicate the problem, some to most loose their steam. The motivation to bring it in to the dealer is that it will get fixed. The frustration is that not only is it not getting fixed, but they can't even seem to find it. Some might even claim not only couldn't they find it, but some 19 year old kid redlined my car all over town, and now it shifts even worse.

We all know Honda's position on this is pure BS, and any junior level mechanic could diagnose this MTF grind/pop/notch in a Safeway parking lot; no need for the freeway. Minimize your trips to the dealer by MANDATING that your presence during testing is required (by you, the owner), and any findings without your presence, you will not accept and will leave it there indefinitely until they comply.
